Seven-Figure Compensation for Catastrophically Injured Cyclist

Cyclists almost always come off worst in collisions with motor vehicles, but they at least have the comfort of knowing that specialist lawyers are there to ensure they are fairly compensated. In a case on point, a man who suffered catastrophic injuries when he was knocked off his bike by a careless driver received seven-figure damages.

The cyclist, aged 50, sustained an extremely severe brain injury when a car emerged into his path from a minor road and hit him. He was left with severe weakness in all four limbs and can only mobilise with assistance. He has limited use of his hands and his speech is seriously impaired. The motorist subsequently pleaded guilty to driving without due care and attention.

After proceedings were launched on the cyclist's behalf, the motorist's insurers admitted primary liability for the accident and, following negotiations, agreed to a final settlement of the claim. Together with a £2.65 million lump sum, the settlement means that the cyclist will receive index-linked and tax-free payments of £275,000 a year to cover the costs of his care for life. The settlement was reduced by an agreed 15 per cent because the cyclist was not wearing a helmet, but still has an overall capitalised value of £6.77 million.
