Nazia Nawaz

Studied at: Crossley Heath Grammar School, Halifax, University of Huddersfield- LLB (Hons) and LPC

Areas of specialism: Civil and Commercial Litigation with particular expertise in land/property related disputes and inheritance disputes.

I first joined Fieldings Porter Solicitors in 2014. Left in June 2017 to work for a national top 25 Law firm where I led the Will, Trust and Estate Disputes team in their Manchester office. I rejoined Fieldings Porter in February 2019.

Expertise before joining the firm: Litigation and Dispute Resolution solicitor with over 10 years of experience in all types of civil and commercial disputes.

Accreditations: Member of the Association of Contentious Trust and Probate Specialists (ACTAPS) and affiliate member of the Society of Trust and Estate Practitioners (STEP) and a member of the Contentious Probate Solicitor section of Certainty.co.uk, the National Will Register.

Notable Cases:

Inheritance Disputes

In the Estate of F Deceased (2015) - Represented the defendants and counterclaimants in a will validity and financial abuse claim. The claim succeeded at trial with a finding of dishonesty against the opponents and an award of indemnity costs in my clients’ favour.

In the Estate of J Deceased (2015) - Promissory estoppel claim on behalf of one of three equal beneficiaries of a Will, who was promised the entire estate by the deceased in return for providing care. The claim settled at mediation with my client receiving over 80% of the estate.

In the Estate of T Deceased (2017) – Claim against executor of estate for hidden assets and failure to distribute. Substantial hidden assets and funds were discovered and the claim settled through ADR. Estimated value of the estate £700,000.

In the Estate of G Deceased (2019) – Acted for the widow of the deceased in a financial provision claim under the Inheritance (Provision for Family and Dependents) Act 1975, where the deceased’s assets had all been owned jointly by the deceased and his brother thereby passing to him by survivorship on the deceased’s death and depriving the estate of any assets. Claim brought under s9 of the Act to bring the deceased’s share of the assets back into the estate. Claim settled through ADR with a substantial payment to the widow and also her three dependent children. Estimated value of the estate £500,000.

In the Estate of W Deceased (2018) - Acted for the disappointed beneficiaries of the deceased’s previous Will, in a will validity claim against the deceased’s carer who was the main beneficiary under a new will. The previous beneficiaries had been excluded from the new will. Value of estate approximately £900,000. The claim was brought on grounds of undue influence and settled at mediation with my clients receiving over 50% of the estate.

In the Estate of L Deceased (2018) - Acted for the long term partner and cohabitee of the deceased who did not inherit under the intestacy rules and the deceased did not leave a will. A claim for financial provision was brought under the Inheritance (Provision for Family and Dependents) Act 1975 and settled through ADR with 90% of the estate assets being transferred to my client.

In the Estate of L Deceased (2016) - Acted for the joint executor and equal beneficiary of the estate in a claim brought against him to remove him as executor. Claim settled through ADR with the appointment of an independent administrator by consent.

In the Estate of G Deceased (2018) - Acted for one of 4 beneficiaries in a dispute with the executors over administration of the estate, delayed distribution and hidden assets. Brought a claim under Part 64 of the CPR for an estate account followed by an application to remove the executor. Estimated value of the estate £3million.

Land/Property Disputes

R G v B (2017) - Acted for the claimant who had inherited a holiday home which had been disused for several years by reason of her parents ill health. On the death of the parents, the claimant discovered that the owners of adjoining land had taken over occupation and possession of the property and had acquired registered title to part of her land through adverse possession. A claim was brought to rectify the title and for a declaration as to ownership of the land and property. The claim settled through ADR.

Re C & C (2016) – Acted for the defendants and counterclaimants in a claim for breach of right of way by owner of adjoining land. Successfully obtained injunction against neighbour to prevent further trespass on my client’s land followed by a warrant of execution.

Re D & B (2019) - Acting for the defendants in a contested adverse possession and disputed right of way claim.

Re C (2017) – Acted for claimant in a boundary dispute relating to two residential properties with a shared drive, which involved several issues relating to the extent of ownership of each parcel of land, the extent of ownership by the parties of the shared drive and the extent of prescriptive rights. The claim settled at mediation.
