£50,000 Compensation for Cyclist Who Hit Pothole

Compensation has been obtained for a cyclist who was injured when his bicycle hit a pothole.

After going for a ride with his cycling club, he was cycling home when he ran into a deep pothole and came off his bicycle, suffering injuries to his hip and pelvis. He was taken to hospital, where he underwent surgery. He was unable to carry out certain domestic tasks for a few months after the accident and needed help from his wife while he recovered.

He brought a claim against the local council, arguing that the depth of the pothole showed it had been there long enough for the council to have been aware of it. However, the council denied liability for the accident. Photographic evidence of the pothole was obtained, and local businesses confirmed that it had been there for some time.

The council made an offer to settle the claim for £45,000, which was rejected. A settlement of £50,000 was subsequently agreed.
