Possession of offensive weapons

Carrying an offensive weapon is a criminal offence as it can cause injury, damage or even death. Unless you have a lawful excuse to be carrying such an object, it can result in fines and even jail time. The main weapon offences are:

  • Possession of offensive weapons – this includes weapons in 3 different categories, as explained below
  • Possession of a knife/bladed article
  • Possession of a firearm – A firearm is a ‘lethal barrelled weapon of any description from which any shot, bullet or other missile can be discharged’.

Offensive weapons can fall under 3 different categories. Firstly, an offensive weapon can be an object which is made for the use of causing injury to the person; this includes objects such as knives and bladed articles. Secondly, an offensive weapon can be any object which is adapted for the purpose of causing injury. Finally, an offensive weapon can be an object which is not made or adapted to cause injury, but it is used with the intention of causing injury.
