The Divorce, Dissolution and Separation Act 2020 came into effect on 6th April 2022. It remains the case that the only ground for divorce is that the marriage or civil partnership has irretrievably broken down.

Previously this needed to be proved by the party applying for the divorce by establishing the existence of one of five factual circumstances, or one of four facts if they were applying to dissolve a civil partnership. This is no longer the case. The necessity to prove the marriage has irretrievably broken down by evidencing one of these facts has been removed.

Parties now are able to divorce or dissolve their civil partnership by simply stating their marriage or civil partnership has irretrievably broken down at any point after they have been married or in a civil partnership for a year.

We appreciate that every case is different and we therefore offer a bespoke level of service in relation to all matters. Under this scheme we charge clients at an hourly rate for the work that we do for them.

With this in mind we offer a consultation of up to an hour with one of our solicitors which, is followed up by a written letter of advice for £200 plus VAT.
